1. WHAT INFORMATION DO WE COLLECT?
Personal information you disclose to us
In Short: We collect personal information that you provide to us.
We collect personal information that you voluntarily provide to us when you make or ask about a reservation, when you use a form on our website, or otherwise when you contact us.
Personal Information Provided by You. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:
- names
- inquiries and contact details submitted voluntarily via on-site chat widget
Sensitive Information. We do not ask for sensitive information. Guests sometimes tell us things that could be considered sensitive, such as a dietary restriction, an allergy, or that they travel with a service animal. We use that only to accommodate the stay, answer the request, or meet a legal obligation.
Payment Data. Payment for a reservation is handled by our payment providers, not by this website. Card details are typed into the provider's own secure form and do not reach our servers. What we receive and keep is the card brand, the last four digits, the expiry date, a provider reference, and the receipt, which is what lets us match a payment to a reservation. Reservations booked on our own booking page are processed by Stripe; reservations booked through our reservation system are processed by ResNexus. All personal information that you provide to us must be true, complete, and accurate, and you must notify us of any changes to such personal information.
Information automatically collected
In Short: Some information - such as your Internet Protocol (IP) address and/or browser and device characteristics - is collected automatically when you visit our Services.
We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. - Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called "crash dumps"), and hardware settings).
- Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.
- Location Data. We do not ask your device for its precise location. Our website never requests location permission and does not use GPS. Our analytics and advertising providers may infer an approximate location, such as a city or region, from the IP address of your connection.
2. HOW DO WE PROCESS YOUR INFORMATION?

- To deliver and facilitate delivery of services to the user. We may process your information to provide you with the requested service.
- To respond to user inquiries/offer support to users. We may process your information to respond to your inquiries and solve any potential issues you might have with the requested service.

- To take and manage your reservation. We process your information to take your reservation, handle its payment, and manage any change or cancellation.
- To save or protect an individual's vital interest. We may process your information when necessary to save or protect an individual's vital interest, such as to prevent harm.
- Process online reservations and manage guest relationships. We collect name, postal address, phone number, and email address through our online reservation process to confirm and manage reservations. We retain this information for as long as it remains necessary to maintain our guest relationship, including to recognize returning guests and to maintain a list of guests excluded from future bookings for safety and fraud prevention purposes. We use this information to operate the inn and to communicate with you. We do not provide it to other businesses for their own marketing.
3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?
In Short: We only process your personal information when we believe it is necessary and we have a valid legal reason (i.e., legal basis) to do so under applicable law, like with your consent, to comply with laws, to provide you with services to enter into or fulfill our contractual obligations, to protect your rights, or to fulfill our legitimate business interests.

Any such business transaction exception is subject to the limits set out in section 4 of this notice and does not permit transfer of our historical guest contact database to a purchaser of the property, a future operator, or any other successor for that party's own marketing, solicitation, or customer development
- If it is contained in a witness statement and the collection is necessary to assess, process, or settle an insurance claim
- For identifying injured, ill, or deceased persons and communicating with next of kin
- If we have reasonable grounds to believe an individual has been, is, or may be victim of financial abuse
- If it is reasonable to expect collection and use with consent would compromise the availability or the accuracy of the information and the collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada or a province
- If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to the production of records
- If it was produced by an individual in the course of their employment, business, or profession and the collection is consistent with the purposes for which the information was produced
- If the collection is solely for journalistic, artistic, or literary purposes
- If the information is publicly available and is specified by the regulations
- We may disclose de-identified information for approved research or statistics projects, subject to ethics oversight and confidentiality commitments
4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?
In Short: We may share information in specific situations described in this section and/or with the following third parties. We do not sell, rent, or trade guest contact information, and we do not transfer our guest list to a buyer of the property or a future lodging operator for that party's own marketing.
We treat the personal and contact information you entrust to Heart of the Village Inn as confidential. This includes your name, email address, telephone number, mailing address, reservation details, and stay history, together with any other information that identifies you or can reasonably be connected to you.
We do not sell, rent, license, trade, or otherwise provide our guest contact database, in whole or in part, to other businesses or unrelated third parties for their own advertising, solicitation, customer acquisition, or marketing. Email addresses that reach us through reservations, inquiries, guest messages, past stays, or any other contact with the inn are not sold, rented, or transferred to another property owner, a future operator, or an unrelated business for that party's own marketing.
The property where we operate may one day be sold, and another business may one day run a lodging business at this address. That does not give the buyer or the future operator any right to receive or use our guest contact information for marketing or solicitation. Our historical guest records are not part of what a purchaser of the real estate acquires for that purpose.
We do write to our own guests from time to time, about a reservation, news from the inn, the end of our operations, a change in ownership, or simply to say thank you. Those messages come from Heart of the Village Inn. They do not give another owner or business access to your information, and they do not make our guest list available to anyone else.
We may need to share your personal information in the following situations:
- Service providers working on our behalf. Running the inn takes outside help, including our reservation platform, payment processor, website and email providers, accountant, and attorneys. They receive only what they need for that work, they act on our instructions, and they are not permitted to use your information to market to you on their own account.
- Legal, tax, and safety obligations. We may disclose information where the law requires or allows it, including in response to legal process, to meet tax and accounting obligations, to prevent fraud, to handle a payment dispute or chargeback, to enforce our agreements, and to establish or defend legal claims.
- Business Transfers. If the business is ever sold, merged, financed, or reorganized, information may move with the records a business is required to keep, such as accounting, tax, and payment records. Our guest contact database is a different matter. It is not transferred to a purchaser of the property, a later owner, a future innkeeper or lodging operator, or any other successor business for that party's own marketing, solicitation, or customer development, and anyone who does receive information in a transaction of that kind may use it only for the operational and legal purposes described in this notice.
- The map on our directions page. Our directions page embeds a Google map. When that map loads, Google receives the IP address of your connection and may set its own cookies. We do not ask for your device location and we do not store any location for you.
5. DO WE USE COOKIES AND OTHER TRACKING TECHNOLOGIES?
In Short: We may use cookies and other tracking technologies to collect and store your information.
We may use cookies and similar tracking technologies (like web beacons and pixels) to gather information when you interact with our Services. Some online tracking technologies help us maintain the security of our Services, prevent crashes, fix bugs, save your preferences, and assist with basic site functions.
We also allow a small number of third parties to use online tracking technologies on our Services. They are: Google Tag Manager and Google Analytics, which measure how the website is used; and The Hotels Network, which personalizes what you see on our booking pages and compares our rates with other sites. Before you accept cookies, Google Analytics runs in a restricted mode: it stores nothing on your device, and it records that a page was viewed without an identifier that would let it recognize you on a later visit. The Hotels Network does not load at all. If you accept, Google Analytics measures your visit in the ordinary way and sets its own cookies, and The Hotels Network loads and stores an identifier in your browser so that it can tell a returning visitor from a new one. If you decline, nothing loads that would not have loaded anyway. These providers use their own technology to perform those functions for us.
To the extent these online tracking technologies are deemed to be a "sale"/"sharing" (which includes targeted advertising, as defined under the applicable laws) under applicable US state laws, you can opt out of these online tracking technologies by submitting a request as described below under section "DO UNITED STATES RESIDENTS HAVE SPECIFIC PRIVACY RIGHTS?"

Google Analytics
We may share your information with Google Analytics to track and analyze the use of the Services. We do not use the Google Analytics advertising features, such as Display Network impressions reporting or remarketing, and Google signals is switched off for our property. To opt out of being tracked by Google Analytics across the Services, visit https://tools.google.com/dlpage/gaoptout. Other opt out means include http://optout.networkadvertising.org/ and http://www.networkadvertising.org/mobile-choice. 6. IS YOUR INFORMATION TRANSFERRED INTERNATIONALLY?

Our servers are located in the United States. Regardless of your location, please be aware that your information may be transferred to, stored by, and processed by us in our facilities and in the facilities of the third parties with whom we may share your personal information (see "WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?" above), including facilities in the United States, and other countries.

7. HOW LONG DO WE KEEP YOUR INFORMATION?

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Notice, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). In practice this means we keep reservation and guest records for as long as they are needed to manage the guest relationship, and for as long as tax, accounting, and other legal requirements demand.
When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.
8. HOW DO WE KEEP YOUR INFORMATION SAFE?
In Short: We aim to protect your personal information through a system of organizational and technical security measures.
We have implemented appropriate and reasonable technical and organizational security measures designed to protect the security of any personal information we process. However, despite our safeguards and efforts to secure your information, no electronic transmission over the Internet or information storage technology can be guaranteed to be 100% secure, so we cannot promise or guarantee that hackers, cybercriminals, or other unauthorized third parties will not be able to defeat our security and improperly collect, access, steal, or modify your information. Although we will do our best to protect your personal information, transmission of personal information to and from our Services is at your own risk. You should only access the Services within a secure environment.
9. DO WE COLLECT INFORMATION FROM MINORS?
In Short: We do not knowingly collect data from or market to children under 18 years of age or the equivalent age as specified by law in your jurisdiction.
We do not knowingly collect, solicit data from, or market to children under 18 years of age, nor do we knowingly sell such personal information. Our website is not directed to children, and the inn itself is adults only: every guest must be 21 or older, without exception. If we learn that personal information from someone under 18 has been collected, we will take reasonable measures to promptly delete it from our records. 10. WHAT ARE YOUR PRIVACY RIGHTS?
In Short: Depending on your state of residence in the US or in some regions, such as the European Economic Area (EEA), United Kingdom (UK), Switzerland, and Canada, you have rights that allow you greater access to and control over your personal information. You may review or correct the information we hold about you, or ask us to delete it, depending on your country, province, or state of residence.
In some regions (like the EEA, UK, Switzerland, and Canada), you have certain rights under applicable data protection laws. These may include the right (i) to request access and obtain a copy of your personal information, (ii) to request rectification or erasure; (iii) to restrict the processing of your personal information; (iv) if applicable, to data portability; and (v) not to be subject to automated decision-making. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with third parties.

On such a request we will delete your information from our active records. We may keep some information to prevent fraud, troubleshoot problems, assist with an investigation, enforce our legal terms, or comply with a legal requirement.

11. CONTROLS FOR DO-NOT-TRACK FEATURES
Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Notice.
California law requires us to let you know how we respond to web browser DNT signals. Because there currently is not an industry or legal standard for recognizing or honoring DNT signals, we do not respond to them at this time.

How to Exercise Your Rights

Under certain US state data protection laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable laws.
Request Verification
Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. We will only use personal information provided in your request to verify your identity or authority to make the request. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes.
If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request and the agent will need to provide a written and signed permission from you to submit such request on your behalf.
Appeals
Under certain US state data protection laws, if we decline to take action regarding your request, you may appeal our decision by emailing us at innkeeper@heartofthevillage.com. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may submit a complaint to your state attorney general.
California "Shine The Light" Law
California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year.
